Privacy Policy: Additional detailed information on personal data protection

This privacy policy (hereinafter, the “Privacy Policy”) aims to provide additional and detailed information to data subjects about the Privacy Policy of the EIFFAGE ENERGÍA business group (hereinafter EIFFAGE ENERGÍA), in compliance with the regulations in this matter, particularly Regulation (EU) 2016/679, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, and Organic Law 3/2018, of 5 December, on Data Protection and the Guarantee of Digital Rights.

This is aimed at helping the User to make informed decisions when using the Website, and to understand how we will process the personal information provided by the User through the various data collection forms on the Website. We invite you to read it carefully to keep control over your personal data at all times.

The User guarantees that the information sent or provided is true, exact, complete and up-to-date, and is liable for any damage or harm, direct or indirect, that may be caused as a result of a breach of this obligation. If the supplied data belong to a third party, the User guarantees that he/she has informed the third party in question of the aspects contained in this Privacy Policy and has previously obtained authorisation to provide their data to EIFFAGE ENERGÍA for the indicated purposes.

What is the purpose of our processing of user personal data?

EIFFAGE ENERGÍA will collect the name and e-mail address of the User through the “Write to us” form in the Contact section for the purpose of contacting the user and sending the requested information.

EIFFAGE ENERGÍA will collect the name and e-mail address of the User through the “Leave a reply” form included in the News section in order to manage and moderate any comments that are posted.

EIFFAGE ENERGÍA will collect the name, e-mail address and training level of the User, as well as any other data appearing in his/her curriculum vitae, through the “Contact us and get started” form in the EIFFAGE ENERGÍA internships section, for the purpose of managing internship applications.

EIFFAGE ENERGÍA will collect the User’s name and e-mail address, as well as other data appearing in his/her curriculum vitae, through the “Would you like to work with us?” form in the Send us your CV section, in order to proceed to manage applications to jobs that are offered.

EIFFAGE ENERGÍA will collect the name, surname and e-mail address of the User, as well as other data relating to the entity he/she represents, through the “Register” form in the Suppliers Portal for the purpose of registering him/her on this website and, once registered by EIFFAGE ENERGÍA, for managing the commercial relationship and, if applicable, proceeding to process his/her registration on the B2B Conecta platform for the purpose of managing the electronic invoicing of the services.

What is the lawful basis for processing User personal data?

The lawful basis that legitimises and allows us to process the User’s personal data is the consent given by the User by explicitly accepting this Privacy Policy, by marking the “check box” provided on each of the aforementioned data collection forms.

In turn, the processing of the data provided by the User in the “Register” form on the Suppliers’ Portal shall also be legitimised by the contractual relationship itself.

For how long will we store the User’s personal data?

EIFFAGE ENERGÍA will store the data provided by the User through the “Write to us” form for the time necessary to proceed to resolve the query and handle the request made by the User.

EIFFAGE ENERGÍA will store the data provided by the User through the “Contact us and get started” and “Would you like to work with us?” forms for the duration of the selection process and for a maximum of four years if your profile is needed to fill other positions at EIFFAGE ENERGÍA.

EIFFAGE ENERGÍA will store the data collected from the User through the “Leave a reply” form indefinitely and as long as the User does not revoke the consent granted for the processing of such data.

Finally, EIFFAGE ENERGÍA shall store the data provided by Users in the “Register” form indefinitely, as long as they do not state their opposition, as the processing of such data is linked to the execution of the contractual relationship. Once this is concluded, these data shall remain blocked by EIFFAGE ENERGÍA for the time strictly necessary to meet any legal obligations that arise and, in any case, for a minimum of ten years for tax purposes and five years for accounting purposes.

To which recipients will the User’s personal data be sent?

The data shall not be sent to third parties, with the exception of competent authorities in the course of their duties. Thus the personal data provided by the User on the Website may be communicated to public bodies, courts and other administrative authorities, if we deem it to be necessary to meet a legal obligation or to take legal actions against claims.

What rights do Users have when providing us with their personal data?

The User has and may exercise the following rights in relation to personal information supplied to EIFFAGE ENERGÍA:

  • Right to access: the User is entitled to obtain confirmation as to whether EIFFAGE ENERGÍA is processing personal data concerning him/her and to access such personal data.

  • Right to rectification: the User may request the rectification of inaccurate data or the completion of incomplete data.

  • Right to erasure (right to be forgotten): Users have the right to request the deletion or erasure of their personal data in certain circumstances where the data are no longer necessary for the purposes for which they were collected, or if they withdraw consent (in relation to processing based on that data), among other reasons.

  • Right to restriction of processing: under certain circumstances, Users may request that we temporarily limit the processing of the personal data that are provided, for example, when challenging the accuracy of the personal data in question or opposing its processing, in which case we will only keep such data for the purposes of making or defending claims.

  • Right to data portability: Users are entitled, in the event of processing by automated means, to obtain the personal data that they have provided to us (in a structured, commonly used machine-readable format) and to request that it be transmitted to another data controller, when technically possible.

  • Revoking consent: Users shall be entitled to revoke their consent at any time.

  • Right to submit a claim to the supervisory authority: if the User has any doubts about our privacy practices, including the way in which we have processed his or her personal data, he or she may file a complaint with the Spanish Data Protection Agency (agpd.es), particularly when he/she is not satisfied with exercising his/her rights.

Users may exercise their legal rights before the Data Controller, at any time, by sending a request in writing to EIFFAGE ENERGÍA at the following email address: lopd.EIE.SPAIN@eiffage.com (Reference: “Exercise of GDPR rights”) which must contain: their first and last name(s), photocopy of D.N.I./N.I.F. (passport or other valid identification document), the specific request, address for notification purposes, date, signature and, if applicable, supporting documents for the request.
